Cleo’s Furniture Terms of Service

Welcome to Cleo's Furniture. In these Terms, "we," "us," and "our" mean Keisler Inc., doing business as Cleo's Furniture. These Terms of Service ("Terms") cover your use of our website and the information, content, and features on it (the "Services").
Our website is a catalog. We do not sell products online. All purchases are made in person at one of our store locations, and each purchase is also governed by the sales order you sign in the store. By visiting or using the Services, you agree to these Terms. If you do not agree, please do not use the Services. These Terms include important limits on our responsibility, including a warranty disclaimer and a limitation of liability.
SECTION 1 - USING OUR WEBSITE
By using the Services, you confirm that you are at least the age of majority in your state of residence. You may use the Services for your own personal, non-commercial use only.
SECTION 2 - PRODUCTS, PRICES, AND ERRORS
Product photos and descriptions are provided for general information. Colors and appearance may look different on your screen than in person. Products shown online may not be in stock at every store. Products, descriptions, prices, promotions, and availability may change at any time without notice. A product or price shown on the website is not an offer to sell. The website may contain errors, and we may correct them at any time. The price and terms of any purchase are those stated on your in-store sales order.
SECTION 3 - DELIVERY
Delivery is available in Arkansas only and is provided by independent third-party delivery companies. Any delivery date or time we give is an estimate only. We are not responsible for delays or for the acts of delivery companies.SECTION 4 - RETURNS AND WARRANTIES Purchases are subject to our Return Policy, which is posted on our website. Manufacturer warranties, if any, are provided by the manufacturer and are not affected by these Terms.
SECTION 5 - OUR CONTENT
The text, photos, graphics, logos, and other content on the Services belong to Keisler Inc. or its licensors and are protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, modify, or republish any of it without our written permission. The Cleo's Furniture name and logo are our trademarks. Other names and logos on the Services belong to their owners.
SECTION 6 - PROHIBITED USES
You may use the Services only for lawful purposes. You may not: - use the Services for any unlawful, fraudulent, or harmful purpose; - infringe our intellectual property or anyone else's; - harass, threaten, or defame our employees or anyone else; - upload viruses or other harmful code; - use robots, scrapers, or other automated tools to access or copy the Services; or - interfere with the security or operation of the Services.
SECTION 7 - SUSPENSION AND TERMINATION
We may suspend or end your access to the Services at any time, for any reason, without notice. Sections 5 through 12 continue to apply after your access ends.
SECTION 8 - RELATIONSHIP WITH SHOPIFY
Cleo's Furniture is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Cleo's Furniture. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Cleo's Furniture, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Cleo's Furniture.

WE DO NOT PROMISE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THIS DISCLAIMER MAY NOT APPLY TO YOU.
SECTION 10 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, KEISLER INC., CLEO'S FURNITURE, AND OUR OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THEIR POSSIBILITY.
SECTION 11 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Keisler Inc., Cleo's Furniture, Shopify, and our owners, directors, officers, employees, agents, contractors, licensors, and service providers from any claims, losses, damages, and liabilities, including reasonable attorneys' fees, arising from (1) your breach of these Terms, (2) your violation of any law or the rights of a third party, or (3) your use of the Services.
SECTION 12 - GENERAL TERMS
Governing law. These Terms are governed by the laws of the State of Arkansas. You agree that any dispute will be decided in the state or federal courts located in Arkansas, and you consent to their jurisdiction. Severability. If any part of these Terms is found unenforceable, it will be enforced to the extent allowed, and the rest of these Terms stay in effect. No waiver. If we do not enforce any part of these Terms, that does not waive our right to enforce it later. Entire agreement. These Terms and our Return Policy are the entire agreement between you and us about the Services. For any purchase, your in-store sales order also applies. Changes. We may change these Terms at any time by posting the updated version on this page. Changes take effect when posted. Your continued use of the Services means you accept the changes.
